What share of federal income tax do the top 1% of earners pay?

The 1% of tax returns with the highest incomes paid 38.4% of all federal income tax in tax year 2023, up from 33.2% in 2001. Their share peaked at 45.8% in 2021, a year of unusually large capital gains, and it tends to rise and fall with the stock market because top incomes include more investment income. Returns are ranked by adjusted gross income, leaving out those of people claimed as dependents. Income tax is what returns owed after credits, never below zero, not counting payroll taxes; tax law also changed over these years, notably in 2013 and 2018. IRS figures are estimates from a sample of returns.
