Terms of Service

Chart.ly reserves the right to remove any image/chart for any reason whatsoever. Specifically, any image/chart uploaded that is pornographic or offensive in nature (including nudity, violence, sexual acts, or sexually provocative images/charts.), infringes upon copyrights not held by the uploader, is illegal or violates any laws, will be immediately deleted and the IP address of the uploaded reported to authorities. Violating these terms will result result in termination of your ability to upload further images/charts.

We reserve the right to ban any individual uploader or website domain from using our servies for any reason.

We cannot be held liable for any damages

By uploading your photos to Chart.ly you give Chart.ly permission to use or distribute your photos and charts on Chart.ly.com or affiliated sites

All images/charts uploaded are copyright © their respective owners

By logging into Chart.ly and using the the service, you agree to the following terms:

Basic Terms

  1. You are responsible to maintain the security of your account and password.
  2. You are responsible for your own behavior. This means you are responsible for all the content that is posted using the Chart.ly service and activity that occurs in your account.
  3. Before posting any content on the Chart.ly service, you agree that you have the right to post that content (text, images, links, or otherwise).
  4. When you give us your Twitter username and password, you authorize us to send information to and receive information from Twitter on your behalf. When you post an update on Chart.ly, we submit it to Twitter; but we do rely on Twitter to accurately and timely post your message on Twitter. We also import content from Twitter and rely on it to give us accurate and timely information.
  5. You will not use the Chart.ly service for any illegal or unauthorized purposes and you won't use the Chart.ly service in a way that violates any laws in any jurisdiction you are subject to.
  6. Chart.ly is not responsible for the content that is posted on the Chart.ly service by its users.
  7. You won't spam other Chart.ly users.
  8. You won't use the Chart.ly service to transmit viruses, worms or other yet-to-be-named malicious software that do bad things to computers, software or the like.
  9. You won't try to hack into the Chart.ly service or unduly burden our servers.
  10. If you want to terminate your Chart.ly account, send us an email and we will delete your account as quickly as possible (but we can't and don't guarantee a timeframe).
  11. You agree to use the Chart.ly service at your own risk! We provide no warranty as to the functionality, uptime, or content. We hope this won't be the case but this may mean that the Chart.ly service may not meet your specific requirements, it may be unavailable, it may have errors, it may be inaccurate or unreliable, or any host of other things you might be unhappy about - so please use the Chart.ly service "as is"!

Chart.ly Rights

  1. We can change any part of the Chart.ly service and even shut Chart.ly down at any time without notice. If we do add new features, tools or functionality to Chart.ly, they will be subject to these terms of service.
  2. We can change these terms of service at any time reason without notice.
  3. We reserve the right to refuse service to anyone for any reason at any time (this includes refusing to grant anyone a new Chart.ly account, terminating an existing Chart.ly account, or refusing to let you use the Chart.ly service just because the sky is blue).
  4. Even though you own the content you submit, you give us a non-exclusive, perpetual, fully-paid, royalty-free, irrevocable license to use the content you provide to the Chart.ly service.
  5. We reserve the right to remove content that is in violation of any applicable law.

Copyrights

  1. We claim no intellectual property rights over the content you post using the Chart.ly service. Your profile and all the content you upload are yours. But because Chart.ly is a public service, you agree that others (including people you may not know or have explicitly given permission to see your content) may view your content.
  2. As we said above, whatever you upload is yours. But you do give us a fully paid, non-exclusive, perpetual, royalty-free license to use your content to provide the Chart.ly service.
